In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), we would like to inform you, that:

I. The administrator of the personal data is Gbb Software - Piotr Maciejewski registered in Warsaw, Cicha 5/3, 00-353 Poland ("Gbbsoft"). Gbbsoft can be contacted at gbbvictronweb@gbbsoft.pl including in the scope of submitting any requests or rights resulting from this information.

II    Personal data will be:
1.   processed for purposes related to the implementation of the Agreement, supervision over its performance, proper settlement and pursuit of claims.
2.    stored for the period of performance of the Agreement and then for the period resulting from the acts governing settlements in business transactions, limitation of claims and until the end of civil, enforcement, administrative and criminal proceedings requiring data processing. The longest of the appointed deadlines is 5 years from the end of the accounting year.

III. The legal basis for the processing of personal data is Article 6.1.b, c and f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), where Article 6.1.b – data processing is necessary for the performance of the Agreement, Article 6.1.c – this processing is necessary to fulfill the legal obligation related to the settlement and storage of accounting and tax documentation, Article 6.1.f – where the legitimate interest of the administrator is the possibility of ongoing contact in matters related to the implementation of the Agreement and protection against possible claims arising from the Agreement.

IV. Categories of processed data: contact details (e-mail address, telephone, first name, last name, address, tax residence), position and place of plants, data used to issue an invoice (e.g. Tax number, Company name and address).

V. Providing personal data is voluntary, but necessary for the proper implementation of the Agreement.

VI. We have received personal data directly from you.

VII. Personal data:
a) will not be transferred to a third countries (except for data required by tax offices of third countries). Personal data will not be profiled and automated.
b) Email and Plant name will be show to installer if you use PromoCode.

VIII Personal data may be made available to third parties providing external services to Gbbsoft to the extent necessary for the provision of these services. Third parties are, in particular, the provider of IT services and systems, entities providing consulting, legal, accounting and audit services.

IX. The person whose personal data are processed is entitled to:
1) access to your personal data.
2) rectify and supplement your personal data - if it turns out that they are incorrect.
3) object to the processing of personal data.
4) delete or limit the processing of data.

X. In the event of non-compliant data processing, the person whose personal data is processed is entitled to lodge a complaint with the supervisory authority. As of 25 May 2018, the supervisory authority entitled to consider the complaint is the President of the Office for Personal Data Protection.

Zgodnie z Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/ 46/WE (ogólne rozporządzenie o ochronie danych) informujemy, że:

I. Administratorem danych osobowych jest Gbb Software – Piotr Maciejewski zarejestrowany w Warszawie, Cicha 5/3, 00-353 Polska („Gbbsoft”). Z Gbbsoft można się kontaktować pod adresem gbbvictronweb@gbbsoft.pl, w tym w zakresie zgłaszania ewentualnych żądań lub praw wynikających z niniejszych informacji.

II    Dane osobowe będą:
1.   przetwarzane w celach związanych z realizacją Umowy, nadzorem nad jej wykonaniem, prawidłowym rozstrzyganiem i dochodzeniem roszczeń.
2.    przechowywane przez okres wykonywania Umowy, a następnie przez okres wynikający z ustaw regulujących rozliczenia w obrocie gospodarczym, przedawnienie roszczeń oraz do czasu zakończenia postępowań cywilnych, egzekucyjnych, administracyjnych i karnych wymagających przetwarzania danych. Najdłuższy z wyznaczonych terminów wynosi 5 lat od zakończenia roku obrachunkowego.

III. Podstawą prawną przetwarzania danych osobowych jest art. 6 ust. 1 lit. b, c i f Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych), gdzie: art. 6 ust. 1 lit. b – przetwarzanie danych jest niezbędne do wykonania Umowy, art. 6 ust. 1 lit. c –przetwarzanie jest niezbędne do wypełnienia obowiązku prawnego związanego z rozliczaniem i przechowywaniem dokumentacji księgowej i podatkowej, art. 6 ust. 1 lit. f – w przypadku gdy prawnie uzasadnionym interesem administratora jest możliwość bieżącego kontaktu w sprawach związanych z realizacją Umowy oraz ochrona przed ewentualnymi roszczenia wynikające z Umowy.

IV. Kategorie przetwarzanych danych: dane kontaktowe (adres e-mail, telefon, imię, nazwisko, adres, rezydencja podatkowa), położenie i lokalizacja instalacji, dane użyte do wystawienia faktury (np. NIP, nazwa i adres firmy).

V. Podanie danych osobowych jest dobrowolne, lecz niezbędne dla prawidłowej realizacji Umowy.

VI. Otrzymaliśmy dane osobowe bezpośrednio od Ciebie.

VII. Dane osobiste:
a) nie będą przekazywane do państwa trzeciego (z wyjątkiem danych wymaganych przez Urzędy Skarbowe państw trzecich). Dane osobowe nie będą profilowane i zautomatyzowane.
b) Adres e-mail i nazwa instalacji zostaną wyświetlone instalatorowi, jeśli użyjesz kodu promocyjnego.

VIII Dane osobowe mogą być udostępniane podmiotom trzecim świadczącym na rzecz Gbbsoft usługi zewnętrzne w zakresie niezbędnym do świadczenia tych usług. Podmiotami trzecimi są w szczególności dostawcy usług i systemów informatycznych, podmioty świadczące usługi doradcze, prawne, księgowe i audytorskie.

IX. Osobie, której dane osobowe są przetwarzane przysługuje:
1) dostępu do swoich danych osobowych.
2) sprostowania i uzupełnienia swoich danych osobowych – jeżeli okaże się, że są one nieprawidłowe.
3) sprzeciwić się przetwarzaniu danych osobowych.
4) usunąć lub ograniczyć przetwarzanie danych.

X. W przypadku niezgodnego z prawem przetwarzania danych osobie, której dane osobowe są przetwarzane przysługuje prawo wniesienia skargi do organu nadzorczego. Od dnia 25 maja 2018 r. organem nadzorczym uprawnionym do rozpatrzenia skargi jest Prezes Urzędu Ochrony Danych Osobowych.
